1. Introduction

Welcome to HVAC Company. These Terms of Service govern your use of our website and services. By accessing our website or engaging our HVAC services, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our services.

HVAC Company is a licensed and insured heating, ventilation, and air conditioning service provider operating in California. We are committed to providing quality HVAC solutions while maintaining transparency and professionalism in all our business dealings.

2. Services Agreement

HVAC Company provides residential and commercial HVAC services including but not limited to:

  • Air conditioning repair, installation, and maintenance
  • Heating system repair, installation, and maintenance
  • Indoor air quality assessment and improvement
  • Emergency HVAC repair services
  • Preventive maintenance plans
  • Commercial HVAC solutions

All services are performed by EPA-certified technicians in accordance with California state regulations and industry standards. Service appointments are subject to availability and must be scheduled in advance, except for emergency services.

We reserve the right to refuse service if safety concerns exist, if the customer's equipment is beyond economical repair, or if the customer has outstanding unpaid balances from previous services.

3. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, checks, and major credit cards. For larger projects, we may require a deposit before work begins.

All estimates are valid for 30 days from the date of issue. Prices are subject to change based on material costs and labor requirements. Any additional work beyond the original scope will be quoted separately and requires customer approval before proceeding.

Late payments may be subject to a service charge of 1.5% per month (18% annually) or the maximum rate permitted by California law, whichever is less. Customers are responsible for all collection costs, including reasonable attorney fees, incurred in collecting past-due accounts.

For maintenance plan customers, payments are due according to the agreed-upon schedule. Failure to maintain current payment status may result in suspension of maintenance services and forfeiture of plan benefits.

4. Cancellation Policy

We understand that schedules change. If you need to cancel or reschedule an appointment, please provide at least 24 hours notice. Cancellations made with less than 24 hours notice may be subject to a cancellation fee of up to $75.

For installation projects where materials have been ordered or work has begun, cancellation fees will apply based on the actual costs incurred. Custom-ordered equipment may not be returnable, and the customer will be responsible for these costs.

HVAC Company reserves the right to cancel or reschedule appointments due to emergency situations, severe weather, or technician availability. In such cases, we will make every effort to notify you as soon as possible and reschedule at your earliest convenience.

5. Limitation of Liability

HVAC Company maintains comprehensive liability insurance and workers' compensation coverage. However, our liability is limited to the direct costs of the services provided or the repair/replacement of equipment damaged due to our negligence.

We are not liable for:

  • Pre-existing conditions or defects in your HVAC system or property
  • Damage caused by improper use, neglect, or unauthorized modifications
  • Consequential damages including lost profits, business interruption, or discomfort
  • Damage to landscaping, driveways, or other property necessary to access equipment
  • Issues arising from failure to follow recommended maintenance schedules
  • Problems caused by inadequate electrical service, gas supply, or ventilation

In no event shall our total liability exceed the amount paid for the specific service in question. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

6. Warranty and Guarantees

We stand behind our work with a 90-day labor warranty on all repairs and installations. This warranty covers defects in workmanship but does not cover normal wear and tear, misuse, or damage caused by external factors.

Equipment and parts are covered by the manufacturer's warranty. We will assist in processing warranty claims, but we are not responsible for manufacturer warranty coverage or limitations. Extended warranties may be available for purchase on certain equipment.

To maintain warranty coverage, customers must:

  • Follow all manufacturer maintenance recommendations
  • Use only authorized service providers for warranty work
  • Maintain proper operating conditions for the equipment
  • Report any issues promptly to prevent further damage

Except as expressly stated herein, we make no other warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

7. Privacy and Data Protection

We respect your privacy and are committed to protecting your personal information. We collect only the information necessary to provide our services, including your name, address, contact information, and service history.

Your information is used solely for:

  • Scheduling and performing HVAC services
  • Sending service reminders and maintenance notifications
  • Processing payments and maintaining account records
  • Improving our services and customer experience

We do not sell, rent, or share your personal information with third parties except as necessary to provide our services or as required by law. For more details, please refer to our Privacy Policy.

8. Governing Law and Dispute Resolution

These Terms of Service are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these terms or our services shall be resolved in the state or federal courts located in California.

Before initiating any legal action, both parties agree to attempt to resolve disputes through good-faith negotiation. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue mediation or arbitration.
